Attending this course will not in itself lead to the OISC granting exemption or registration which is dependent on passing OISC audits and procedures.

Course content

  • overview of UK immigration control; entry clearance, leave to enter and remain – the main categories of entry and stay under the Immigration Rules – working in the UK under the Point Based System and rules outside of this
  • the rights of refugees and those with discretionary leave/humanitarian protection to family reunion, benefits, etc
  • asylum application procedures; fast-track and detention
  • application of the European Convention of Human Rights to UK immigration decisions, absolute and qualified rights and relevant case law
  • paragraph 320 – dealing with the general grounds for refusal and re-entry bans
  • enforcement of immigration control – offences; illegal entry and overstaying; new offences under 2004 Act; liability to administrative removal and deportation
  • detention and bail; powers of detention; how to secure release through bail from a CIO
  • entitlement to British nationality and the right of abode; acquiring citizenship through registration/naturalisation/ discretionary applications
  • rights of appeal; time limits; appeal procedures; the one-stop process
  • EEA nationals and their rights under EU law; the rights of family members who are third country nationals; procedures relating to residence and family permits: the Workers Registration Scheme
