The purpose of this course is to provide an update, and a general guide to the law relating to spouses, fiancé(e)s, and partners.

Course content

The course will focus on recent developments, but also look at the different categories of applicant who can apply. It will specifically cover the requirements and law for:

• The Immigration Rules – entry clearance and recent changes (in particular Appendix FM and the transitional provisions)

• Settlement under the Rules

• Domestic Violence Rules

• Bereaved Spouse Rules

• Other categories in the Rules (eg armed forces, spouses of PBS users)

• Refugees and protection cases

• Human Rights claims involving partners

• Policies and applications outside the Rules

• EEA Law and recent developments

Objectives

At the end of the course participants should be able to:

• understand current legal issues, in particular recent changes and case-law developments

• advise clients on whether they qualify to enter/remain as a spouse/partner in the UK

• understand documents/evidence required and the application process

• know when to challenge refusals
