Legal Aid & Private Fees Information

LEGAL AID

Legal Aid is subject to both a means and a merits assessment. JCWI have a legal aid contract and so are able to represent clients under legal aid where they are financially eligible and where the case is in scope (please note that since the 1st April 2013 cases involving Article 8 ECHR only are not automatically in scope).

Please contact our mainline number to provide a description of your case. Our team will be able to advise you as to whether legal aid is potentially available to you. Even where legal aid is not automatically available, in some cases it is possible to apply for Exceptional Case Funding. JCWI have extensive experience in this area and are happy to advise should this be relevant in your case. Our team will also be able to talk you through the documentation you would need to provide to confirm your financial eligibility for legal aid.

Please note that JCWI are unable to represent clients in detention centres under legal aid. However, JCWI are able to represent clients who are detained in prison, whether serving their criminal sentences or detained under immigration powers. JCWI have considerable experience of securing release from detention by way of bail, by assisting with unlawful detention claims in the higher courts and have a proven track record in winning appeals against deportation. Initial drop-in interview & one off advice (30 - 45 minutes)

£75.00 - £125.00 depending on the complexity of the case

Entry clearance applications

In country applications to the Home Office (including human rights
claims)

Preparation of and representation at an immigration appeal before the First Tier Tribunal

(inclusive of counsel fees)

Lodging a judicial review (initial paper permission application)

fee agreement (CFA).*

costs implications will be discussed in advance with clients.
